Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Somnio mobile application ("App"), operated by Psyber Consulting ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use Somnio. By using the App, you represent that you meet this requirement. Users under 18 should review these Terms with a parent or guardian.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@trysomnio.app if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Somnio offers Free, Standard, and Premium subscription tiers. Paid subscriptions are billed through Google Play and are subject to Google Play's billing terms. Subscription fees are charged at the start of each billing period and are non-refundable except where required by applicable law.

You may cancel your subscription at any time through Google Play. Cancellation takes effect at the end of the current billing period. We do not process refunds for partial billing periods.

Prices are displayed in your local currency on Google Play. Prices may change with reasonable notice.

4. Time Capsule Feature

The Time Capsule feature allows you to schedule messages for future delivery to nominated recipients. By using this feature, you acknowledge and agree that:

• You are responsible for ensuring you have the recipient's consent to receive the message.
• Once a capsule has been delivered, it cannot be recalled from the recipient's email inbox.
• We will make reasonable efforts to deliver capsules at the scheduled time but cannot guarantee delivery in the event of technical failures, email filtering, or other circumstances beyond our control.
• You must not use the Time Capsule feature to send unsolicited, harassing, illegal, or harmful content.

5. Acceptable Use

You agree not to use Somnio to:

• Upload or transmit content that is unlawful, harmful, defamatory, or infringing on third-party rights.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the App.
• Interfere with or disrupt the App's servers or infrastructure.
• Use the App for any commercial purpose not expressly authorised by us.

6. AI-Generated Content

Dream interpretations provided by Somnio are generated by an AI language model. These interpretations are provided for personal reflection and entertainment purposes only. They do not constitute psychological, medical, or professional advice of any kind. You should not make important decisions based solely on AI-generated interpretations.

7. Intellectual Property

The Somnio App, including its design, code, and branding, is owned by Psyber Consulting and is protected by applicable intellectual property laws. Content you create within the App (dream entries, voice recordings, Time Capsule messages) remains your property. You grant us a limited licence to store and process this content solely for the purpose of providing the service.

8. Availability and Changes

We strive to keep Somnio available and reliable, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the App or any feature at any time with reasonable notice where possible.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Psyber Consulting shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the App, including loss of data or undelivered Time Capsule messages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or by email. Continued use of Somnio after changes take effect constitutes your acceptance of the revised Terms.
